The Labour Relations Act, No. 66 of 1995, as amended make provision that one or more registered trade unions and one or more employers’ organisation may form a bargaining council. What will the powers and functions of such a bargaining council be? (5)

Powers and functions of bargaining councils include:

  • Creation and implementation of collective agreements
  • The establishment and administration of a dispute settlement fund to avoid and settle labor disputes
  • Promoting and developing schooling and training schemes
  • Creation and administration of schemes or funds for the benefit of their parties or members
  • Developing and submitting recommendations on policies and regulations concerning a particular industry or region

In much the same way as The Commission for Conciliation, Mediation and Arbitration (CCMA), some bargaining boards have the status to settle labor disputes. Therefore, where an accredited negotiating council exists, the CCMA would not have the authority to preside over labor disputes in a specified market.

The commissioners assisting in the negotiating council's disagreements are trained with the particular sector and labor arrangement when it comes to conflict settlement. The parties will then receive expert counsel and assistance from the commissioner with respect to the settlement of conflicts.
