On 24th February 1803 the Marbury v, Madison case brought to light the major issue that affected checks and balances to the Supreme Court. The U.S Supreme Court declared an act of the congress unconstitutional, hence, the doctrine of judicial review was established. The judicial review which was the court’s opinion is one of the foundations of the constitution law of the U.S. The above case gave federal courts the power to declare executive and legislative acts unconstitutional. The opinion was written by chief justice John Marshall after a 4-0 decision. The ruling in the case outlined that states had no power to tax institutions established by the federal government. The landmark case further strengthened the position of federal states power over the states. Thus the courts power to interpret the constitution was affirmed.
