In order to encourage his daughter to excel in her studies, Mr Z enters into an agreement with his daughter, in terms of which Mr Z agrees to buy his daughter a car, on the condition that she passes all of her Semester 2 modules. However, Mr Z’s daughter is not willing to wait that long and wants to have the car at the beginning of Semester 2, but she is not sure whether this is possible. She is also worried that she might fail one of her six modules for Semester 2 and does not know whether her dad would still buy her a car if this happens. Comprehensively discuss the concept of ‘conditions’ in the law of contract, and advise Mr Z’s daughter regarding her two (2) concerns, as mentioned in the scenario above. (25)

Conditions in any contract determine the obligations of each party. In this case, Mr. Z is obligated to purchase a car for her daughter if she passed all her semester exams. As the daughter therefore, you are obligated to pass your module exams so that you father can meet his obligation to buy the new car. Your concern is that you might fail in one of the 6 modules, which stipulates that you will not have met your obligation as per the contract conditions. You are also not willing to wait for that long thus wants the car at the beginning of the semester. None of these issues meet the conditions of the contract you had with your father. Thus, based on the conditions of the contract, there is chance that your father will not buy you a new car
